“I have been associated with Bailey Cook for approximately 20 years and worked with him on complex litigation approximately ten years. During that time I have found him knowledgeable of real property litigation, eminent domain, surface damages, water rights, right of way law and related matters.
In 1993, the US Supreme Court handed down the landmark case of Daubert v. Merrell Dow Pharmaceuticals, Inc., 509 U.S. 579 (1993). During that time frame, I was appointed by the Oklahoma Bar Association as a member of the Evidence Committee to review and comment and propose changes to the Oklahoma law regarding evidence. Mr. Cook was the first attorney to my knowledge in Oklahoma to pursue the use of the Daubert standards to challenge expert witnesses valuations of real property and surface damages in court testimony. From his early role in pushing the use of Daubert challenges we jointly developed a legal brief on the subject that was distributed and widely used in real property litigation.
